These terms and conditions are for goods purchased from Gillian Hutton trading as Circles and Shadows Jewellery and Design.
1. Terms
By accessing this web site, you are agreeing to be bound by these web site Terms and Conditions of Use, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.
3. Disclaimer
The materials on Circles and Shadows Jewellery and Design website are provided 'as is'. Circles and Shadows Jewellery and Design makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Circles and Shadows Jewellery and Design does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site.

In no event shall Circles and Shadows Jewellery and Design or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on this Internet site, even if Circles and Shadows Jewellery and Design or a Company authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

Any claim relating to the School’s website shall be governed by the laws of the Circles and Shadows Jewellery and Design home jurisdiction - the United Kingdom, England -  without regard to its conflict of law provisions.

9. Contract for sale or services
When submitting an order to Circles and Shadows Jewellery and Design, you are entering into a contract with us to supply you with jewellery items as described in the product details. This contract will become binding upon our acceptance of your order.
In the rare circumstance of the product you ordered not being available, we will contact you as soon as possible to discuss a refund or a substitute product. If your purchase is a stock product (not made to order) your order will be shipped within 5 working days.
Items that are made to order can take up to 3 weeks, but you will be given an estimated dispatch time when your order is received or the design details are agreed. At peak times such as Christmas and Valentine’s Day this may be a little longer, but details will be discussed at ordering.

Please contact us if your order is urgent.
 10. Delivery times
All pieces will be dispatched as soon as possible but please allow 5 working days. If there is a delay for any other reason we will contact you via the email you provided at the point of purchase.
You will receive confirmation by email once your jewellery has been dispatched.
Should you urgently need an item for a specific date or special occasion please contact us circlesandshadowsjewellery@gmail.com and we will do our utmost to get the item to you by the required date.
We do not currently deliver to anywhere outside of the UK.
11. Delivery costs
Your order will be sent by Special Delivery. This service typically takes 2 number of days from the date of dispatch.
We cannot guarantee delivery times.
Delivery times vary and we cannot be held liable for late delivery of goods caused by circumstances beyond our reasonable control. You are responsible for making arrangements to receive the goods and if the goods are held at the post office or other delivery company’s depot because no one was available when the goods were delivered then it is your responsibility to collect the goods as quickly as possible. It is important that the addresses supplied by you to us are accurate.
12. Returns
Making Returns
In the unlikely event that you are unhappy with your purchase, you can return item(s) within 14 days of receipt. The item(s) need to be returned in their original packaging and we will refund your order once we receive the product. Please note, if an exchange is required, please contact us as soon as possible at circlesandshadowsjewellery@gmail.com
Custom made orders, (i.e. those made to a requested size not generally listed on the website or with personalisation), are exempt from this policy, but if you have a problem, please contact us.
Pack the items back in the parcel, include the paperwork and send it back to:
Unfortunately we cannot except returns on earrings for health and safety reasons.
We will be unable to provide refunds or replacements where damage has been caused by accident, neglect or misuse.
We strongly recommend that you return your jewellery using tracked delivery, and want to emphasise that jewellery is only insured in transit when posted using Royal Mail’s Special Delivery service. Any other delivery method is at your own risk and we will be unable to refund items lost in transit where they are not insured in transit.
We cannot accept responsibility for parcels lost in transit. A prompt refund of the price of the goods will be issued once all the information referred to above is received. The credit card used for the original purchase will be credited with the original price. If there are any problems with your refund, we will contact you.
We will confirm the return address in writing, once you have contacted us about a return.
13. Damaged items
If you should receive an item that is defective, damaged or not what you ordered, please contact circlesandshadowsjewellery@gmail.com within 5 working days and provide an image of the damaged goods. We will help you resolve any issues as quickly as possible by replacing the item and arrange for you to return the faulty item to us by post. Should this occur, we will cover additional delivery costs and re-arrange delivery of a new replacement item. We will confirm the return address in writing, once you have contacted us about the fault.
If you suspect a parcel has been damaged in transit, parcels should be opened in the presence of the Courier upon receipt of the goods. This will allow you to verify that the Goods are contained in the parcel are untampered with and undamaged. Should you fail to do this, and subsequently find the Goods are not contained therein, or have been damaged during delivery, we may not be able to claim against the Courier or against our insurers. Accordingly, if you do fail to do this, you agree that you will be solely liable for any such loss or damage and shall waive, release and indemnify us from and against any claims relating thereto, to the fullest extent permitted by applicable law.
All our manufacturing work is covered for up to 6 months from the receipt of your jewellery. Should a fault occur within this timeframe, please contact circlesandshadowsjewellery@gmail.com with details of the issue and photos of the fault.
We will then require the piece to be sent to us for inspection. If it is determined during the inspection that the damage has been caused by accident, neglect or misuse, here will be a small charge for this service, to cover the cost of the repair along with any shipping costs incurred.
Please note that we are not liable for any other jewellers work. A faulty jewellery item corrected by another jeweller voids our warranty period.
14. Cancelation policy - Goods
If you wish to cancel an order placed online at Circlesandshadows.co.uk that has not yet been dispatched, please email us as soon as possible circlesandshadowsjewellery@gmail.com
Please note that once your order has been dispatched, we are unable to cancel it. Once you have received your order, you have 14 days to contact us at circlesandshadowsjewellery@gmail.com to request a refund, then a further 14 days to return the item to us. The item(s) will need to be returned in perfect, unworn condition and in their original packaging to be eligible for a refund. In this circumstance, please follow the above return instructions.
Your refund will be processed within 14 calendar days.
The above does not affect your statutory rights.
Purchases exempt from both the refund and exchange policies, unless they are structurally faulty are:
- Bespoke pieces (commission work)
- Customised pieces (pieces that have been altered from their original design shown online).
- Earrings if the hygiene seal has been broken.

15. Late and lost deliveries
UK Delivery - We unfortunately cannot refund or replace lost items until 20 working days after the date of dispatch (30 days for international items) as this is when the Royal Mail classes items as being lost.
Items not received but tracked as being delivered - This frequently happens when items are delivered to places of work. In some cases, your item might have been delivered to a post room or colleague within your company and someone else will have signed for it. You can check the signature of the person that has signed for the parcel, by entering your tracking number on the Royal Mail website. Please note that we do not refund or replace items that are tracked as being delivered. For this reason, we always recommend that you get items delivered to your home address.
You are responsible for making arrangements to receive the goods and if the goods are held at the post office or other delivery company’s depot because no one was available when the goods were delivered then it is your responsibility to collect the goods as quickly as possible. It is important that the addresses supplied by you to us are accurate.

Circles and Shadows Jewellery and Design cannot be held responsible for goods that are lost or delayed in transit.

16. Disclaimer and Liability
We reserve the right to change, modify, substitute or remove without notice any information on the site from time to time. We will try to ensure that all descriptions and illustrations of the items on the site are accurate but there may be slight variations due to print and publishing limitations and the use of natural products and handmade nature of the products which will vary.
You must use the site for lawful purposes only. You are fully responsible and liable for all access made to the site using any password or user name that you register with us. You should keep such passwords and user names confidential at all times.
